MINUTES OF THE ATTICA TOWNSHIP BOARD

Held on October 8th, 2009

At a meeting of the Attica Township Board held on October 8th, 2009, at the Attica Township Hall, 4350 Peppermill Road, Attica, Michigan. The meeting was called to order at 7 p.m. by Supervisor Ochadleus. PRESENT:Supervisor Al Ochadleus, Clerk Nancy Herpolsheimer, Treasurer Pam Mason, and Trustee Phillip Madeline. ABSENT: Trustee Richard Lacey. ALSO PRESENT: Attorney Michael Gildner and the public per the Sign-In Sheet attached.

The minutes of the September 10th, 2009 regular Board meeting were reviewed by the Board; and there being no additions, corrections or deletions;

MOTION by Madeline, seconded by Mason to approve the September 10th, 2009 Attica Township Board minutes as presented. A vote was taken. Ayes: All; Nays: None. MOTION CARRIED.

CORRESPONDENCE: Clerk Herpolsheimer informed the Board that the auditors were unable to attend the meeting and will set a new date to attend.

TREASURER’S REPORT: Treasurer Mason gave the following Treasurer’s Report: Beginning Balance of $274,624.91 receipts of $64,412.93; Interest of $49.53; Distributions of $45,279.65 for a New Balance of $293,807.72. Public Safety has $33,409.22; Fire Millage has $2,650.51 and there is $1,178.74 in the Lake George Road Special Assessment account.

MOTION by Madeline, seconded by Herpolsheimer to approve the Treasurer’s Report as presented. A vote was taken. Ayes: All; Nays: None. MOTION CARRIED.

POLICE REPORT: Supervisor Ochadleus gave the following police report: 188 calls were received in the month of September, with 116 of them handled by the Township’s deputies.

OLD BUSINESS:

1. Dean Campbell Case:

Attorney Gildner reported that he attended court on Mr. Campbell’s court date but Mr. Campbell did not appear. Mr. Campbell owes the Township $990.00 and the property owner, Mr. Upleger, has been informed that this amount can be assessed to his property if it remains unpaid.

2. Assessor Payroll Classification:

Attorney Gildner has reviewed Assessor Bob Gottschalk’s contract and stated that Assessor Gottschalk must now be classified as a Township employee.

NEW BUSINESS:

1. Attica Township Meeting Procedures:

Attorney Gildner drafted a document of procedures for addressing the Township Board/Commission.

MOTION by Mason, seconded by Madeline to adopt the Attica Township Procedures for Addressing Township Board/Commission. A vote was taken. Ayes: All; Nays: None. MOTION CARRIED.

2. Team Attica:

Supervisor Ochadleus read a letter from Team Attica organizer Angie Burgess thanking the Township for their support of the First Annual Team Attica Auto Show.

3. Museum Donation Policy:

There was discussion regarding forming a policy for handling donations to the Attica Township Museum. Attorney Gildner will draft a policy.

4. Employee Issue, Third Party Appointment:

MOTION by Herpolshiemer, seconded by Madeline to appoint Attorney Mike Gildner to handle a township personnel issue. A roll call vote was taken. Mason: Aye; Madeline: Aye; Ochadleus: Aye and Herpolsheimer: aye. Ayes: All; Nays: None. Absent: One. (Lacey). MOTION CARRIED.

5. Police Contract:

Supervisor Ochadleus reviewed the police contract and explained cost allocation. Supervisor Ochadleus recommended approval by the Township Board of the 2010 Police Contract at a cost of $123, 829.21.

MOTION by Herpolshiemer, seconded by Mason to approve the 2010 Law Enforcement Contract as presented. A roll call vote was taken. Herpolsheimer: Aye; Ochadleus: Aye; Madeline: Aye and Mason: aye. Ayes: All; Nays: None. Absent: One. (Lacey). MOTION CARRIED.

COMMITTEE REPORTS

1. FIRE: Fire Chief Warford reported:

a) There were 5 fire runs in the month of September.

b) Chimney fires are common this time of the year.

c)  Many wires were brought down by the recent storms.

d) Chief Warford brought in 911 Millage flyers to put at the front desk. This led to discussion of the 911 election and Attorney Gildner advised the Board not to put the flyers in the front office until he investigates whether it is acceptable because of the language of the flyers.

e) Three fire fighters have started school.

2. PARK: Park Manager Madeline reported:

a) JAS Steel will repair damaged bridges in the park.

b) The Little League will put diamond dust down on the baseball diamonds once the ground is frozen.

3. PLANNING COMMISSION: Planning Commission Secretary Bud Fackler reported that there was not an October meeting.

4. ATTORNEY REPORT: Attorney Gildner had nothing additional to report.

5. AMBULANCE: None.

6. CEMETERY: Bill Winslow reported that the pump in the cemetery will be unhooked for the season next week.

7. COMMISSIONER REPORT: Commissioner Jarvis discussed the 911 election. Supervisor Ochadleus commended Commissioner Jarvis for staying on top of the 911 issue.

8. BOARD: Clerk Herpolsheimer went over the following budget adjustment needed:

Transfer $6,000 from the General Fund to the Fire Department to cover expenses.

MOTION by Madeline, seconded by Mason to transfer $6,000 from the General Fund to the Fire Department to cover expenses. A roll call vote was taken. Herpolsheimer: Aye; Mason: Aye; Ochadleus: Aye and Madeline: aye. Ayes: All; Nays: None. Absent: One (Lacey). MOTION CARRIED.

PUBLIC: Resident Michelle Stowell of 4339 Newark Rd. asked what the church next to her home, New Life Christian Fellowship, is building and stated that she does not want any building done on the property. Supervisor Ochadleus said that the church is building a pavilion. Planning Commission Secretary Bud Fackler said that he will ask Pastor Martin to modify special land use site plan.

REVIEWING AND PAYING BILLS:

The bills were reviewed by the Board in the amount of $54,511.80 and there being no questions:

MOTION by Madeline, seconded by Mason to approve the bills as presented. A roll call vote taken. Madeline: Aye; Mason; Aye; Ochadleus: Aye and Herpolsheimer: Aye. Ayes: All. Nays: None. Absent: One (Lacey).  MOTION CARRIED.

There being no further business before the Board, MOTION by Madeline seconded by Mason to adjourn the meeting at 8:00 p.m. A vote was taken. Ayes: All. Nays: None. MOTION CARRIED.
