MINUTES OF THE ATTICA TOWNSHIP BOARD

Held on November 12th, 2009

At a meeting of the Attica Township Board held on November 12th, 2009, at the Attica Township Hall, 4350 Peppermill Road, Attica, Michigan. The meeting was called to order at 7 p.m. by Supervisor Ochadleus. PRESENT:Supervisor Al Ochadleus, Clerk Nancy Herpolsheimer, Treasurer Pam Mason, Trustee Richard Lacey and Trustee Phillip Madeline. ABSENT: None. ALSO PRESENT: Attorney Michael Gildner and the public per the Sign-In Sheet attached.

The minutes of the October 8th, 2009 regular Board meeting were reviewed by the Board; and there being no additions, corrections or deletions;

MOTION by Lacey, seconded by Madeline to approve the October 8th, 2009Attica Township Board minutes as presented. A vote was taken. Ayes: All; Nays: None. MOTION CARRIED.

CORRESPONDENCE: None

TREASURER’S REPORT: Treasurer Mason gave the following Treasurer’s Report: Beginning Balance of $293,808.72 receipts of $4,117.18; Interest of $48.20; Distributions of $33,242.67 for a New Balance of $264,731.43. Public Safety has $23,641.52; Fire Millage has $1,947.30 and there is $1,178.74 in the Lake George Road Special Assessment account.

MOTION by Lacey, seconded by Madeline to approve the Treasurer’s Report as presented. A vote was taken. Ayes: All; Nays: None. MOTION CARRIED.

POLICE REPORT: Deputy Kardell gave the following police report: 227 calls were received in the month of October, with 137 of them handled by the Township’s deputies. Deputy Kardell advised residents to keep on eye out for trespassers and report them.

OLD BUSINESS:

1. Museum:

Supervisor Ochadleus explained expense vouchers for Trustee Madeline’s work for the Attica Museum. There was discussion.

MOTION by Mason, seconded by Lacey to approve Trustee Madeline’s expense vouchers totaling $172.46, for his work for the Attica Museum. A roll call vote was taken. Madeline: Abstain; Lacey: Aye; Herpolsheimer: Aye, Mason: Aye and Ochadleus: Aye. Ayes: All; Nays: None. Abstained: One. MOTION CARRIED.

2. Police Contract:

Supervisor Ochadleus explained the revised police contract which is $33.00 less than the original contract which the Board signed. Commissioner Jarvis discussed cost allocation and recommended approval of the police contract.

MOTION by Herpolsheimer, seconded by Mason to approve the revised Police Contract. A roll call vote was taken. Mason: Aye; Ochadleus: Aye; Madeline: Aye, Lacey: Aye and Herpolsheimer: Aye. Ayes: All; Nays: None. MOTION CARRIED.

NEW BUSINESS:

1. Auditor’s Report:

Auditor Ryan King, Certified Public Accountant, presented the Audited Financial Report dated June 30th, 2009. Auditor King explained that overall Attica Township is financially sound with a healthy fund balance. There was discussion and:

MOTION by Herpolsheimer, seconded by Mason to accept the Audited Financial Report dated June 30th, 2009. A roll call vote was taken. Lacey: Aye; Mason: Aye; Herpolsheimer: Aye, Madeline: Aye and Ochadleus: aye. Ayes: All; Nays: None. MOTION CARRIED.

2. Ryan King, Certified Public Accountant - W2s:

Ryan King, Certified Public Accountant, explained what his services would include to prepare the Township’s W2s. The proposal includes the following services at a cost of $400:

4th Quarter Form:

941 Employers Quarterly Federal Tax Return

Annual Forms:

165 - Michigan Sales, Use and Withholding report

W-2’s, W-3, 1009/s and 1096 (which includes the reconciliation of the forms from the four quarters with the W-2’s and W-3)

There was lengthy discussion. Supervisor Ochadleus requested a one year contract from Mr. King.

3. January Township Board Meeting Date:

Supervisor Ochadleus will be out of town for the regularly scheduled January 2010 Township Board meeting.

MOTION by Herpolsheimer, seconded by Mason to reschedule the January 14th, 2010 Township Board meeting to January 7th, 2010 at 7 p.m. and to reschedule the time for the January 7th, 2010 Planning Commission meeting to 6 p.m. A vote was taken. Ayes: All; Nays: None. MOTION CARRIED.

COMMITTEE REPORTS

1. FIRE: Fire Chief Warford reported:

a) The Fire Department is hosting the Firefighters Association and Fire Chief’s meeting on December 9th.

b) Reminded residents to change the batteries on their smoke detectors and to clean their chimneys.

c)  He attended the Fire Chief’s meeting on November 11th and the failed 911 millage was discussed.

2. PARK: Park Manager Madeline reported:

a) He has invited the head of the Attica Little League to attend a Township Board meeting.

b) The Little League has $400 that they will use for diamond dust.

3. PLANNING COMMISSION: Planning Commission Secretary Bud Fackler reported:

a) The Planning Commission approved Lapeer County Collision and Pizza Depot’s sign application on the condition that the specific message transition and duration time as well as the brightening and dimming of the sign are approved by the Planning Commission.

b) Planning Commission member Madeline asked Planner Bessey to look into available grants for playground equipment for the park.

c) New Life Christian Church is adding a ball diamond and pavilion to their property and Planner Bessey indicated that a Public Hearing was not needed because the church is not changing the use of their Special Land Use, Attorney Gildner concurred.

d) The County recommended approval of the Wind Energy and Temporary Mobile Home ordinances. The Township Board will approve these ordinances next month.

4. ATTORNEY REPORT: Attorney Gildner reported:

a) He drafted the policy for Attica Museum donations.

b) He has met with employees regarding the personnel issue.

5. AMBULANCE: Supervisor Ochadleus gave a brief history of Lapeer County EMS. There was discussion.

6. CEMETERY: None

7. COMMISSIONER REPORT: Commissioner Jarvis reported:

a) Official results of the 911 election.

b) Discussed SEV and Taxable Values declining and CPI.

c) ”Project Homeless” will be held January 28th, 2010

d) Mary Hawkins, of Lapeer County Promise, talked to the County Commissioners regarding providing a scholarship for each school in the County.

e) Discussed budget cuts for the County.

8. BOARD: Clerk Herpolsheimer went over the following budget adjustment needed:

Transfer $5,000 from the General Fund to the Fire Department to cover expenses.

MOTION by Herpolsheimer, seconded by Lacey to transfer $5,000 from the General Fund to the Fire Department to cover expenses. A vote was taken. Ayes: All; Nays: None. MOTION CARRIED.

EXECUTIVE SESSION:

The Attica Township Board went into executive session at 8:10 p.m. to review the advice of legal counsel regarding a personnel issue.

MOTION by Lacey, seconded by Madeline at 8:10 p.m. to go into executive session with Township Attorney Gildner regarding the letter he drafted to the Township Board on November 10th, 2009 written under attorney/client privilege. A roll call vote was taken. Madeline: Aye; Herpolsheimer: Aye; Mason: Aye, Ochadleus: Aye and Lacey: Aye. Ayes: All; Nays: None. MOTION CARRIED.

The Attica Township Board continued open session at 8:21 p.m.

MOTION by Mason, seconded by Herpolsheimer to acknowledge receipt of the letter dated November 10th, 2009 from Attorney Gildner written under attorney/client privilege and to consider the issue closed. A roll call vote was taken. Ochadleus: Aye; Mason: Aye; Lacey: Aye, Herpolsheimer: Aye and Madeline: Aye.Ayes: All; Nays: None. MOTION CARRIED.

PUBLIC: Resident Michelle Dougherty asked for clarification regarding the personnel issue and was informed that no further action will be taken and it is a closed issue.

REVIEWING AND PAYING BILLS:

The bills were reviewed by the Board in the amount of $79,417.47 and there being no questions:

MOTION by Lacey, seconded by Madeline to approve the bills as presented. A roll call vote taken. Mason: Aye; Lacey: Aye; Herpolsheimer: Aye; Ochadleus: Aye and Madeline: Aye. Ayes: All. Nays: None. MOTION CARRIED.

There being no further business before the Board, MOTION by Lacey seconded by Madeline to adjourn the meeting at 8:25 p.m. A vote was taken. Ayes: All. Nays: None. MOTION CARRIED.
