MINUTES OF THE ATTICA TOWNSHIP BOARD

At a meeting of the Attica Township Board held on April 8th, 2010, at the Attica Township Hall, 4350 Peppermill Road, Attica, Michigan. The meeting was called to order at 7 p.m. by Supervisor Ochadleus. PRESENT: Supervisor Al Ochadleus, Clerk Nancy Herpolsheimer, Treasurer Pam Mason, Trustee Richard Lacey and Trustee Phillip Madeline. ABSENT: None. ALSO PRESENT: Attorney Mike Gildner and the public per the Sign-In Sheet attached.

The minutes of the March 4th, 2010 regular Board meeting were reviewed by the Board; and there being no additions, corrections or deletions;

MOTION by Lacey, seconded by Madeline to approve the March 4th, 2010 Attica Township Board minutes as presented. A vote was taken. Ayes: All; Nays: None. MOTION CARRIED.

CORRESPONDENCE: None

TREASURER’S REPORT: Treasurer Mason gave the following Treasurer’s Report: Beginning Balance of $389,961.11 receipts of $105,593.39; Interest of $78.39; Distributions of $34,699.97 for a New Balance of $460,933.12. Public Safety has $142,649.75; Fire Millage has $63,515.29 and there is $772.04 in the Lake George Road Special Assessment account. There is a C.D. in the amount of $72,390.52.

MOTION by Lacey, seconded by Madeline to approve the Treasurer’s Report as presented. A vote was taken. Ayes: All; Nays: None. MOTION CARRIED.

POLICE REPORT: Supervisor Ochadleus gave the following police report: 187 calls were received in the month of March, with 121 of them handled by the Township’s deputies.

OLD BUSINESS:

1. Property Acquisition:

Supervisor Ochadleus signed the purchase agreement with Terry and Caron Snow for $75,000 for the 10 acres south of the park on April 1st.

MOTION by Madeline, seconded by Herpolsheimer to authorize Supervisor Ochadleus to execute the purchase of the ten acre Snow parcel for $75,000. A roll call vote was taken. Mason: Aye; Madeline: Aye; Ochadleus: Aye; Lacey: Aye and Herpolsheimer: Aye. Ayes: All; Nays: None. MOTION CARRIED.

Supervisor Ochadleus has been in negotiation with Ron and Lisa Bollman to trade 5 acres of the Snow property, once it is purchased, for 5 acres plus 66 feet of roadway.

MOTION by Madeline, seconded by Mason to authorize Supervisor Ochadleus to execute the transfer of 5 acres of the parcel purchased from Terry and Caron Snow to Ron and Lisa Bollman in exchange for 5 acres plus 66 feet of roadway. A roll call vote was taken. Lacey: Aye; Ochadleus: Aye; Herpolsheimer: Aye; Mason: Aye and Madeline: Aye. Ayes: All; Nays: None. MOTION CARRIED.

NEW BUSINESS:

1. Appoint New Member to Library Board:

MOTION by Herpolsheimer seconded by Madeline to appoint Michele Dougherty to fill the remainder of Shirley Edward’s term on the Library Board. A vote was taken. Ayes: All; Nays: None. MOTION CARRIED.

2. Budget Information:

There was discussion regarding the Attica Township Budget for fiscal year July 2010 through June 2011. There will be a Budget Workshop on April 22nd. Numbers from all departments need to be given to Clerk Herpolsheimer by April 15th.

COMMITTEE REPORTS

1. FIRE: Fire Chief Warford reported:

a) There were 4 runs in the month of March. Two were billable runs and have been collected.

b) There was a state wide burning ban for several days in April.

c) The Fire Department Spaghetti Dinner and Auction will be held Saturday, April 10th from 4 - 7 p.m.

d) The Tornado Siren will be tested the 1st Saturday of every month at 1 p.m.

2. PARK: Park Manager Madeline reported:

a) Diamond dust has been put on the baseball fields by the Little League.

b) Memorial bench has been ordered for resident and he is working on the plaque.

c) Porta Johns are in.

3. PLANNING COMMISSION: Planning Commission Secretary Bud Fackler reported:

a) Dave Penzien was elected Chairman of the Planning Commission, Bob Stochwell was elected Vice-Chairman and Bud Fackler was elected secretary at the April 1st Planning Commission meeting

b) The Planning Commission voted to recommend to the Township Board approval of site plan and mining permit to Barrett Paving with conditions. Since the meeting Secretary Fackler has received complaints regarding the noise of the crusher therefore it was decided to wait on approval of the permit until the crusher issue can be resolved.

c) The Planning Commission will hold four meetings per year and will hold several training sessions.

4. ATTORNEY REPORT: Attorney Gildner reported:

a) Upleger is due in court on April 12th.

b) Imlay Township’s case regarding the asphalt plant at Newark and Summers is due to come before the Court of Appeals on April 13th.

5. AMBULANCE: None.

6. CEMETERY: The water pump has been reinstalled.

7. COMMISSIONER REPORT: Commissioner Linda Jarvis reported:

a) The Lapeer County Water Parks may open with staff from the Mental Health Department.

b) The Commissioners are working on the County Budget.

c) She attended a conference in Lansing last week and learned there may be a 3% cut in Revenue Sharing.

d) Lapeer County is the 11th most distressed County in the nation.

e) Discussed funding for Senior Citizens.

f) She heard good things about Representative Daley at the conference in Lansing.

8. BOARD: None.

PUBLIC: Resident Elaine Thayer asked about the repaving of Imlay City Road.

REVIEWING AND PAYING BILLS:

The bills were reviewed by the Board for the General Fund for the amount of $31,784.63, Public Safety for the amount of $18,884.45 and for the Fire Fund for the amount of $36,270.36 and there being no questions:

MOTION by Lacey, seconded by Madeline to approve the bills as presented. A roll call vote taken. Ochadleus: Aye; Lacey: Aye; Madeline: Aye; Herpolsheimer: Aye and Mason: Aye. Ayes: All. Nays: None. MOTION CARRIED.

There being no further business before the Board, MOTION by Lacey seconded by Madeline to adjourn the meeting at 7:55 p.m. A vote was taken. Ayes: All. Nays: None. MOTION CARRIED.
