The meeting was called to order by Chairman David Penzien at 7:04 p.m. The following members were PRESENT: Geraldean Berry, Nancy Szerlag, Kent Gierman, Bud Fackler, Nancy Szerlag, Phillip Madeline and David Penzien. Minutes of the April 1^st, 2010 regular Planning Commission meeting minutes were reviewed and there being no corrections, additions or deletions:

2. Planner Dave Birchler.

Planner Birchler commended Attica Township for being forward thinking regarding planning. Planner Birchler and the Planning Commission members discussed:

MOTION by Szerlag, seconded by Berry that the Planning Commission establish a policy that it will hold a special meeting, at an applicant’s request, on the first Wednesday of the month in months when there is not a meeting scheduled provided the applicant pays a reasonable fee to defray the Township’s expenses associated with a special meeting. PUBLIC TIME: Discussion regarding Phil Starr operation on Newark Road and the possibility of non-compliance of their Special Land Use.

At a regular meeting of the Attica Township Planning Commission held on the 1^st day of April, 2010 at the Attica Township Hall, 4350 Peppermill Road, Attica, MI 48412.

The meeting was called to order by Chairman David Penzien at 7:00 p.m. The following members PRESENT: Geraldean Berry, Nancy Szerlag, Kent Gierman, Bud Fackler, Phillip Madeline and David Penzien. Absent: Robert Stockwell. ALSO PRESENT: Student member Daniel Gavette, Planner Dave BIrchler, Attorney Michael Gildner, and the public per the attached sheet.

A moment of silence was observed in honor of long time Planning Commission member John Thompson and in honor of Planning Commission member Kent Gierman’s father, who both passed away.

Minutes of the January 7^th, 2010 regular Planning Commission meeting minutes were reviewed and there being no corrections, additions or deletions:

MOTION by Berry, seconded by Penzien to nominate Bud Fackler as Secretary of the Attica Township Planning Commission for the year 2010; and MOVED further by Berry, seconded by Penzien that the nominations be closed and a unanimous ballot be cast. 2. Barrett Paving: Site Plan Review and recommendation to the Township Board.

John Krispin of Barrett Paving introduced Peter Collins of ASTI Enviromental, representing Barrett Paving. Mr. Collins presented Barrett Paving’s proposal to finish out their borrow pit on the east side of Lake George, north of Belle River Road over the next several years. Barrett Paving is seeking approval of Phase 1 at this time.

Township Planner Dave Birchler reviewed his recommendations and recommended Planning Commission approval of the site plan and Township Board approval of the mining permit for Barrett Paving Industries’ proposed Phase 1 operations only, subject to the following conditions:

(1) Planning Commission and Township Board approval of the spot elevations and interpolated contours, in place of the required 2 – foot contour map.

(2) An increase of 33 feet in the mining setback from the Belle River Road right-of-way.

(3) The type of equipment and number of pieces to be used during Phase 1 shall be specified.

(4) An estimate of the time-table for completion of Phase 1 shall be included.

(5) The plans shall identify areas where the fence will be repaired or include a site development note to that effect, along with a commitment to maintain all “Keep Out-Danger” signs for the duration of the Phase 1 operations.

(6) Provide a brief description of the operator and 24- hour contact information (name, address, phone) of the person in charge.

(7) Provide sealed plans.

Supervisor Ochadleus requested the hours of operation for mining and a defined haul route.

There was lengthy discussion.

MOTION by Fackler, seconded by Berry to recommend to the Township Board approval of site plan and mining permit to Barrett Paving with the condition that the following requirements are met:

The minutes of the May 10^th, 2010 regular Board meeting were reviewed by the Board; and there being no additions, corrections or deletions;

CORRESPONDENCE: Supervisor Ochadleus reviewed a letter received from Detroit Edison regarding service in case of a possible strike and a letter from John Cosens, Drain Commissioner, regarding the contract with Owen Tree service to spray the Barber drain.

TREASURER’S REPORT: Supervisor Ochadleus gave the following Treasurer’s Report: Beginning Balance of $474,711.18 receipts of $48,521.45; Interest of $73.84; Distributions of $91,266.60 for a New Balance of $432,039.87. Public Safety has $131,718.28; Fire Millage has $70,824.62 and there is $2,395.10 in the Lake George Road Special Assessment account. The C.D. was cashed in to use for the Township land acquisition.

POLICE REPORT: Deputy Nick Vandenberg gave the following police report: 173 calls were received in the month of May, with 97 of them handled by the Township’s deputies.

OLD BUSINESS:

1. Williams Street Parking:

Supervisor Ochadleus reported that the parking problem on Williams Street is in the system and the Road Commission is aware of the situation and has verified that this is a health, safety and welfare issue. Williams Street parking will remain on the Attica Township Board meeting agenda until the problem is resolved.

NEW BUSINESS:

1. Afflack:

A representative of Afflack discussed the insurance plans offered by Afflack. There was discussion and the representative will meet with Supervisor Ochadleus to review the available insurance plans.

2. 2010-2011 Budget Approval:

Supervisor Ochadleus summarized the 2010-2011 Budget which was presented at last month’s (May 13^th, 2010) Board meeting.

3. Attica Baseball:

A representative of Attica Baseball was not present. Clerk Herpolsheimer indicated that the Attica Baseball board’s names and phone numbers were faxed to the township office.

4. Hall Rental for 3 Long Term Employees:

There was discussion regarding three long term employees holding parties for their graduating seniors in June and the possibility of waiving the rental fee and deposit.

MOTION by Herpolsheimer to waive the rental fee and deposit for hall rental for three Attica Township employees.

The motion died because of lack of support.

5. Fence for New Property:

Supervisor Ochadleus distributed proposals from Action Fence and B.J.’s Maintenance for a fence and gate for the new Township property. There was discussion.

MOTION by Lacey, seconded by Madeline to approve the proposal by B.J.’s Maintenance for $5,000.00 for fence and access gate for the Township property. A roll call vote taken. COMMITTEE REPORTS

1. FIRE: Fire Chief Warford reported:

a) There were 5 runs in the month of May of which three were extractions.

b) Campbell was burning brush without a permit; Chief Warford issued him a permit because he was burning acceptable material.

c) Discussed 911 Committee meeting held at the Attica Fire Hall.

2. PARK: Park Manager Madeline reported:

a) A new power washer is needed for the park; the old one is 25 years old.

3. PLANNING COMMISSION: Planning Commission Secretary Bud Fackler reported:

a) At the June Planning Commission meeting a schedule was set for the meetings for the remainder of the year. The meetings will be the first Wednesday of the month in August, October and December. These dates need to be published in the newspaper.

b) Recommended to the Township Board that if a resident can not wait for a scheduled meeting the Township Board should set a fee to meet on an off month.

c) Discussed Phil Starr hours of operation since they were awarded the contract for work on I-69. Supervisor Ochadleus and Bud Fackler gave Phil Starr permission to operate 6 a.m. – 6 p.m. Monday through Friday.

4. ATTORNEY REPORT: Attorney Gildner reported:

a) The Bowlman property closing was uneventful.

b) An injunction has been issued in the Upleger/Campbell case. The next step is to enforce it.

5. AMBULANCE: None.

6. CEMETERY: None.

7. COMMISSIONER REPORT: Commissioner Linda Jarvis reported:

a) The 2010 budget has been amended and work on 2011 budget has begun. There is hope that Revenue Sharing will come back.

B) General Squire Water Park opens June 12^th and will be open 7 days per week. The Jail crew will cut the grass.

c) The Senior millage is coming up. The seniors are packaging for overseas servicemen and are looking for postage donations.

d) The Relay for Life is June 12^th.

e) She was a victim for the mock disaster drill in Dryden on June 4^th.

8. BOARD:

a) Clerk Herpolsheimer requested permission to purchase the Pontem cemetery program for $2,111 for the license and $487 annually for updates and training. Supervisor Ochadleus suggested observing the program in use at a township that currently uses the program. There was discussion.

b) Budget Ammendments:

MOTION by Lacey, seconded by Madeline to transfer $27,202 from the General Fund Balance and $73,543 from the cashed in c.d. for the land acquisition (details attached). A roll call vote taken. Herpolsheimer: Aye; Ochadleus: Aye; Madeline: Aye; and Lacey: Aye. Ayes: All. Nays: None. Absent: One (Mason) MOTION CARRIED.

c) Supervisor Ochadleus spoke with Mitch Caskey, Environmental Health Director, regarding smoking on township property and was informed that maintenance workers are not permitted to smoke in the maintenance building but are permitted to smoke outside of the building.

The bills were reviewed by the Board for the General Fund for the amount of $45, 145.73 Public Safety for the amount of $783.19 and for the Fire Fund for the amount of $13,784.96 and there being no questions:

PUBLIC HEARING:

a) TRUTH IN TAXATION FISCAL YEAR 2010-2011:

Supervisor Ochadleus opened the Public Hearing at 7:40 p.m. explaining and reviewing the figures for the Township Operating Millage, The Township Fire Operating Millage and the Township Public Safety Millage. The maximum allowable millage under the Headlee Act for the township operating is 1.4653, the fire operating is 0.9042 and public safety is 1.0.

MOTION by Lacey, seconded by Mason to approve the Truth in Taxation as presented. A vote was taken. Ayes: All; Nays: None. MOTION CARRIED.

b) BUDGET PUBLIC HEARING FISCAL YEAR 2010-2011:

Supervisor Ochadleus reviewed the July 1^st, 2010 – June 30^th, 2011 budget explaining how the figures were arrived at.

There being no questions or comments the Truth in Taxation Fiscal Year 2010-2011 and the 2010-2011 Budget Public Hearings were closed at 7:50 p.m. and the regular Attica Township Board meeting commenced.

1. Property Acquisition:

Attorney Gildner stated that he has prepared the deed to transfer the Bollman property to the Township and a second deed to swap property. The documents have been sent to the bank.

NEW BUSINESS:

1. State Representative Phil Pavlov:

State Representative Phil Pavlov, Republican candidate running for a State Senate seat introduced himself to the Board and residents and discussed his political record.

2. Village Parking:

Residents Bruce and Jenny Holladay and Daniel and Melissa Stern came before the Board to voice their concerns regarding the dangerous parking practices on Williams Street. Many patrons of Rowley’s Grocery Store have been parking on Williams Street instead of using the lot located north of the store and use the resident’s driveways as turn-arounds. The Holladays and Sterns also brought a letter voicing their concerns and photos documenting the parking problem.

Attorney Gildner recommended the Board adopt a resolution supporting a No Parking Sign request on Williams Street, Section 15, Attica Township, T7N R11 E. Lapeer County. Attorney Gildner will research the rights of the Township to put up a sign. Attorney Gildner will prepare the draft resolution.

MOTION by Herpolsheimer, seconded by Mason to adopt a resolution supporting a No Parking Sign on Williams Street. A roll call vote taken. Lacey: Aye; Herpolsheimer: Aye; Ochadleus: Aye; Madeline: Aye and Mason: Aye. Ayes: All. Nays: None. MOTION CARRIED.

COMMITTEE REPORTS

1. FIRE: Fire Chief Warford reported:

a) There were 3 runs in the month of April. One was a PI rescue in front of Davlin Farms

b) The Fire Chiefs Association created a 911 committee.

c) Assistant Chief Dougherty is working on a grant for new fire equipment.

d) Chief Warford attended Fire Inspector classes and is now a certified Fire Inspector.

2. PARK: Park Manager Madeline reported:

a) The plaque for the new bench is being made and will be mounted on the ground.

b) The Little League President, Stewart Shafer, presented the Board with the Attica Little League financial report and requested permission to hold a Little League Tournament at the park in the summer of 2011 to raise money to improve the fields. There was discussion. Attorney Gildner stated that this is a policy issue and that if the tournament is held the Township should be included on the Little League’s insurance. Supervisor Ochadleus requested Mr. Shafer provide the Board with the names and positions of each person on the Little League Board and detailed information regarding the proposed tournament and bring all information to the July Township Board meeting.

3. PLANNING COMMISSION: Planning Commission Secretary Bud Fackler reported:

a) There was not a meeting in May.

b) Planner Birchler would like to change the day of the Planning Commission meetings because of conflicts with other township’s meetings.

4. ATTORNEY REPORT: Attorney Gildner reported:

a) The Court of Appeals found in favor of Imlay Township in the Asphalt paving plant case.

b) Mr. Upleger is due in court on May 24^th. Mr. Upleger did not attend the preliminary injunction hearing. No commercial activity is allowed on Mr. Upleger’s property but commercial activity is taking place on the property.

5. AMBULANCE: None.

6. CEMETERY: None.

7. COMMISSIONER REPORT: Commissioner Linda Jarvis reported:

a) The Seniors are requesting a .25 mill on the August ballot.

b) The Commissioners have made cuts and balanced the budget for 2010 and are now working on the 2011 budget.

c) Answered questions regarding the 911 millage.

8. BOARD: Clerk Herpolsheimer requested permission to attend the Michigan Association of Clerk’s conference in Mt. Pleasant and the Policy and Procedure Conference in Frankenmuth.

MOTION by Mason, seconded by Madeline to authorize Clerk Herpolsheimer to attend the Michigan Association of Municipal Clerk’s conference and the Policy and Procedure Conference not to exceed a cost of $1,000. 1. Property Acquisition:

Supervisor Ochadleus signed the purchase agreement with Terry and Caron Snow for $75,000 for the 10 acres south of the park on April 1st.

Supervisor Ochadleus has been in negotiation with Ron and Lisa Bollman to trade 5 acres of the Snow property, once it is purchased, for 5 acres plus 66 feet of roadway.

MOTION by Madeline, seconded by Mason to authorize Supervisor Ochadleus to execute the transfer of 5 acres of the parcel purchased from Terry and Caron Snow to Ron and Lisa Bollman in exchange for 5 acres plus 66 feet of roadway. NEW BUSINESS:

1. Appoint New Member to Library Board:

2. Budget Information:

There was discussion regarding the Attica Township Budget for fiscal year July 2010 through June 2011. There will be a Budget Workshop on April 22nd. Numbers from all departments need to be given to Clerk Herpolsheimer by April 15th.

COMMITTEE REPORTS

1. FIRE: Fire Chief Warford reported:

a) There were 4 runs in the month of March. Two were billable runs and have been collected.

b) There was a state wide burning ban for several days in April.

c) The Fire Department Spaghetti Dinner and Auction will be held Saturday, April 10th from 4 - 7 p.m.

d) The Tornado Siren will be tested the 1st Saturday of every month at 1 p.m.

2. PARK: Park Manager Madeline reported:

a) Diamond dust has been put on the baseball fields by the Little League.

b) Memorial bench has been ordered for resident and he is working on the plaque.

c) Porta Johns are in.

3. PLANNING COMMISSION: Planning Commission Secretary Bud Fackler reported:

a) Dave Penzien was elected Chairman of the Planning Commission, Bob Stochwell was elected Vice-Chairman and Bud Fackler was elected secretary at the April 1st Planning Commission meeting

b) The Planning Commission voted to recommend to the Township Board approval of site plan and mining permit to Barrett Paving with conditions. Since the meeting Secretary Fackler has received complaints regarding the noise of the crusher therefore it was decided to wait on approval of the permit until the crusher issue can be resolved.

c) The Planning Commission will hold four meetings per year and will hold several training sessions.

4. ATTORNEY REPORT: Attorney Gildner reported:

a) Upleger is due in court on April 12th.

b) Imlay Township’s case regarding the asphalt plant at Newark and Summers is due to come before the Court of Appeals on April 13th.

5. AMBULANCE: None.

6. CEMETERY: The water pump has been reinstalled.

7. COMMISSIONER REPORT: Commissioner Linda Jarvis reported:

a) The Lapeer County Water Parks may open with staff from the Mental Health Department.

b) The Commissioners are working on the County Budget.

c) She attended a conference in Lansing last week and learned there may be a 3% cut in Revenue Sharing.

d) Lapeer County is the 11th most distressed County in the nation.

e) Discussed funding for Senior Citizens.

f) She heard good things about Representative Daley at the conference in Lansing.

8. BOARD: None.

PUBLIC: Resident Elaine Thayer asked about the repaving of Imlay City Road.

At a meeting of the Attica Township Board held on March 4th, 2010, at the Attica Township Hall, 4350 Peppermill Road, Attica, Michigan. The meeting was called to order at 7 p.m. by Supervisor Ochadleus. PRESENT:Supervisor Al Ochadleus, Clerk Nancy Herpolsheimer, Treasurer Pam Mason, and Trustee Phillip Madeline. The minutes of the February 11th, 2010 regular Board meeting were reviewed by the Board; and there being no additions, corrections or deletions;

Public Safety has $141,758.53; Fire Millage has $96,444.55 and there is $33,301.02 in the Lake George Road Special Assessment account. There is a C.D. in the amount of $72,390.52.

OLD BUSINESS:

1. Property Acquisition:

Supervisor Ochadleus reported that he has offered $75,000 to the owners of the 10 acres behind the park adjacent to the Township land. There is not a purchase agreement yet.

NEW BUSINESS:

1. DDA Potential:

Supervisor Ochadleus explained what a Downtown Development Authority is and various programs that the Township could participate in to generate money. Supervisor Ochadleus asked the Director of the Almont DDA to gather information to see if a DDA would benefit Attica Township.

2. Sheriff’s Contract:

Supervisor Ochadleus reported that the Sheriff’s department has gone from pre-billing to post billing and giving detailed line item information on costs. This will be a substantial savings.

3. Budget Forecast:

Supervisor Ochadleus went over the assessment roll report and explained changes and classification. Clerk Herpolsheimer will give up to date budget numbers at the next Board meeting (April 8th). The budget workshop will be April 22nd.

4. Reappoint Kent Gierman & Bob Stockwell to the Planning Commission:

Supervisor Ochadleus recommended reappointing Kent Gierman and Bob Stockwell to the Planning Commission.

MOTION by Mason, seconded by Madeline to reappoint Kent Gierman and Bob Stockwell to the Planning Commission for a three year term. A vote was taken.Ayes: All; Nays: None. Absent: One (Lacey). MOTION CARRIED.

COMMITTEE REPORTS

1. FIRE: Fire Chief Warford reported:

a) There were 6 runs in the month of February.

b) The Fire Department assisted at the Champion Bus fire for 13 hours

c)  The Fire Department assisted EMS by breaking into a home where a sick resident was unable to open the door. The Fire Department also put out a snowmobile fire, assisted at a structure fire in Lapeer and assisted an elderly couple whose car rolled over on I-69.

d) There will be a pancake breakfast at the Fire Hall on March 20th and a Spaghetti Dinner/Auction in April.

e) Requested direct deposit of the Fire Department’s pay checks beginning with the next fiscal year.

2. PARK: Park Manager Madeline reported that diamond dust has been put on the baseball fields.

3. PLANNING COMMISSION: Planning Commission Secretary Bud Fackler reported:

a) There was not a Planning Commission meeting in March.

b) He will meet with Barrett and Birchler on March 11th.

c) Supervisor Ochadleus and Secretary Fackler had a meeting with Planner Birchler regarding the economy and the need to reduce planning fees.

4. ATTORNEY REPORT: Attorney Gildner provided a written report with details of the complaint against Richard Upleger, the owner/landlord of the property occupied by Dean Campbell.

5. AMBULANCE: None.

6. CEMETERY: None.

7. COMMISSIONER REPORT: Commissioner Linda Jarvis reported:

a) There will be a Road Commission meeting Mach 24th at 6 p.m.

b) There will be a dinner at the Center Building on March 18th featuring all Michigan made products with a presentation by Farm Bureau.

c) She will be unable to attend 911 meetings because of scheduling conflicts and will not vote to put it on the August ballot.

8. BOARD: Supervisor Ochadleus reported that the Township roads will receive one less brining this year and that the Township is committed to spending $50,000 less this year on roads.

POLICE REPORT: Deputy Nick Vandenberg gave the following police report: 167 calls were received in the month of January, with 101 of them handled by the Township’s deputies.

OLD BUSINESS:

1. Dean Campbell Issue:

Supervisor Ochadleus reported that he has had a complaint from a resident because Dean Campbell continues to run an illegal business at the property he leases from Richard Upleger. Supervisor Ochadleus and Zoning Administrator Fackler have met with Mr. Campbell and offered to work with him but he has disregarded there offer to help him resolve the situation. Attorney Gildner suggested proceeding with action against both Mr. Upleger and Mr. Campbell. The Township Board authorized Attorney Gildner to proceed with action against Mr. Upleger and Mr. Campbell.

2. Fee Schedule for Township Hall:

After comparing hall rental rates with the other township halls in Lapeer County it was decided that the rates for renting the Attica Township Hall will not be raised.

NEW BUSINESS:

1. Lauren Hager State Senate Candidate:

Senate candidate Lauren Hager gave a brief family, education, work and political history of his life and discussed his goals for Michigan.

2. Property Acquisition:

The parcel of property adjacent to the ten acres that is owned by the Township behind the park may be come available. The owner has contacted the Township to see if there is interest in purchasing it. Attorney Gildner suggested the Board authorize Supervisor Ochadleus to negotiate purchase of the property.

MOTION by Herpolsheimer, seconded by Madeline to authorize Supervisor Ochadleus and Attorney Gildner to pursue land acquisition.  A roll call vote was taken. Herpolsheimer: Aye; Mason: Aye; Madeline: Aye and Ochadleus: Aye. Ayes: All; Nays: None. Absent: One (Lacey). MOTION CARRIED.

3. Township Pension Plan:

After a meeting with the Township employees and Natalie Braden of Burnham & Flower Insurance Group Supervisor Ochadleus had reservations regarding changing the Township pension plan from John Hancock to Nationwide and recommended the Township Board rescind the resolution to change to Nationwide.

MOTION by Madeline, seconded by Mason to rescind the January 7th, 2010resolution to change the Township pension plan form John Hancock to Nationwide. A roll call vote was taken. Ochadleus: Aye; Herpolsheimer: Aye; Madeline: Aye and Mason: Aye. Ayes: All; Nays: None. Absent: One (Lacey). MOTION CARRIED.

4. Road Commission Ash Tree Removal Proposal:

Supervisor Ochadleus advised the Board of a letter faxed to the Township by the Road Commission proposing removal of infected and dead ash trees along the roads in the Township. The proposal was for $10,000 with $5,000 to be paid by the Township and the Road Commission absorbing $5,000. It was decided to decline the proposal.

COMMITTEE REPORTS

1. FIRE: Fire Chief Warford reported:

a) There were four fire runs in the month of January.

b) The Pancake breakfast was a success with approximately 100 people served.

c)  A spaghetti dinner fundraiser will be held in April.

d) The owner of the dog that was rescued by the Fire Department is bringing the dog to the Fire Hall to meet the rescuers and give them an award.

2. PARK: Park Manager Madeline reported:

a) The tennis courts need to be dismantled because they are a safety issue. They should be blocked off until they are dismantled.

b) He gave a resident price information for donating a bench to the park.

3. PLANNING COMMISSION: Planning Commission Secretary Bud Fackler gave the Township Board the Planning Commission annual report as required by law. Secretary Fackler also reported that the CountyPlanningseminar is March 13th at Almont Middle School.

MOTION by Madeline seconded by Mason to authorize sending all interested Board members, Planning Commission members and ZBA members to theCountyPlanning seminar at Almont Middle School on March 13th at a cost of $25 per person. b) Discussed budget cuts and the good financial condition of the Township.

PUBLIC: Resident Carol Eisenhardt of 2645 Lake George Road asked about the future plans for the proposed land acquisition.

POLICE REPORT: Attica Township’s new deputy, Nick Vandenberg, was introduced by Supervisor Ochadleus. Deputy Vandenberg gave the following police report: 171 calls were received in the month of December, with112 of them handled by the Township’s deputies.

NEW BUSINESS:

1. Building Modification:

Supervisor Ochadleus reported that he received a bid from Soulliere Construction and Contracting to repair the township hall ceiling to prevent ice dams. Supervisor Ochadleus went over the details of the contract. There are funds for the repairs in the budget. There was discussion.

MOTION by Madeline, seconded by Mason to approve the contract with Soulliere Construction and Contracting to repair the township hall ceiling, with the condition that Mr. Soulliere provides proof of insurance to Attorney Gildner prior to construction and compensation.  A roll call vote was taken. 2. Lapeer Community Recycling Program:

There was discussion regarding the Lapeer Community Recycling Program contract with Deerfield Disposal. The program has been cut to 10 times per year and Lapeer County no longer contributes to the program. It was decided that Attica Township will no longer participate and Clerk Herpolsheimer will contact Deerfield Disposal to inform them of the decision.

MOTION by Lacey, seconded by Madeline not to sign the 2011 contract with Deerfield Disposal to participate in the Lapeer Community Recycling Program. A vote was taken. Ayes: All; Nays: None. MOTION CARRIED.

3. Summer Tax Collection of School Taxes Agreement:

MOTION by Mason, seconded by Lacey to adopt the Summer Tax Collection of School Taxes Agreement with Imlay City Community Schools. A vote was taken. Ayes: All; Nays: None. MOTION CARRIED.

4. Ruth Hughes Memorial Library Trustee Appointment:

MOTION by Herpolsheimer, seconded by Mason to reappoint Shirley Edwards to the Ruth Hughes Memorial District Library Board for a term beginningJanuary 1st, 2010 through December 31st, 2013. A vote was taken. Ayes: All; Nays: None. MOTION CARRIED.

5. Fee Schedules for Hall and Zoning:

Supervisor Ochadleus presented a letter from Planning Coordinator Bud Fackler recommending two ways that the Township could cut costs:

a) The actual cost of going before the ZBA is higher than the fee charged and should be raised.

b) Holding Planning Commission meetings the four times per year required by law instead of monthly, or when there is true business that can not be put off to one of the four meetings.

MOTION by Madeline, seconded by Mason to modify the ZBA fee to $600.00 as recommended by Planning Coordinator Bud Fackler and to schedule Planning Commission meetings four times per year as required by law. A vote was taken. Ayes: All; Nays: None. MOTION CARRIED.

Supervisor Ochadleus also discussed the cost of renting out the hall verses the income generated and the need to raise the rental fees. There was discussion. Deputy Clerk Valerie Schultz will contact the other townships in Lapeer County to find out their rates for renting their hall and this will be discussed at the next board meeting.

6. Hall Repairman Billing:

There was discussion regarding a bill from a hall repairman for services that had not been requested and for which there was no documentation.

MOTION by Ochadleus, seconded by Madeline to decline payment of the bill from Mark Thompson and also to change the lock on the front door and adopt an issued keys policy. A vote was taken. Ayes: All; Nays: None. MOTION CARRIED.

7. Resolution for Township Pension Plan Change:

MOTION by Herpolsheimer, seconded by Lacey to adopt a resolution to update the Township’s Pension Plan by replacing John Hancock Pension Defined Contribution Pension Plan for Government Employees and transferring the Participant Account Values to a Nationwide Plan (Customized Retirement Plan Solution).

A vote was taken. Ayes: All; Nays: None. MOTION CARRIED.

COMMITTEE REPORTS

1. FIRE: Fire Chief Warford reported:

a) There were five fire runs in the month of December including the ice rescue of a dog and one chimney fire.

b) The Fire Department will be holding a Pancake Breakfast fundraiser on January 24th from 8 a.m. tonoon to raise money for new equipment.

c)  Chief Warford is looking closely at expenses and discussed ways the department could cut costs.

2. PARK: Park Manager Madeline reported:

a) The tennis courts need to be dismantled because they are a safety issue.

b) A request to park snow mobile trailers at the park during a race at Grass Lake was denied.

3. PLANNING COMMISSION: Planning Commission Secretary Bud Fackler stated that the Planning Commission recommends approval of the amended site plan for New Life Christian Fellowship Church.

MOTION by Herpolsheimer seconded by Madeline to approve the amended site plan of New Life Christian Church to add a ball field, pavilion and playground area. A vote was taken. Ayes: All; Nays: None. MOTION CARRIED.

4. ATTORNEY REPORT: Attorney Gildner explained how the money due was collected in the Campbell Case.

a) Supervisor Ochadleus commended Attorney Gildner on the outstanding job he has done for the Township.

b) Supervisor Ochadleus distributed an article regarding Township consolidation and there was discussion.

c) Supervisor Ochadleus informed the Board that Deputy Treasurer Tietz and Receptionist Lemons will be going to the Board of Review training.

d) Treasurer Mason requested all articles for the Township Newsletter be submitted to her before the end of the month.
