       MINUTES OF THE ATTICA TOWNSHIP BOARD

 

Held on August 13th, 2009

At a meeting of the Attica Township Board held on August 13th, 2009, at the Attica Township Hall, 4350 Peppermill Road, Attica, Michigan.  The meeting was called to order at 7 p.m. by Supervisor Ochadleus.  PRESENT:  Supervisor Al Ochadleus, Clerk Nancy Herpolsheimer, Treasurer Pam Mason, Trustee Richard Lacey and Trustee Phillip Madeline. ABSENT: None.  ALSO PRESENT: Attorney Michael Gildner and the public per the Sign-In Sheet attached.

 

The minutes of the July 9th, 2009 regular Board meeting were reviewed by the Board; Trustee Phillip Madeline indicated that page 3, item b of the minutes should read:

 

b)         Two weeks ago there was a problem with the garbage cans in the back pavilion being tipped over and the back Port a John was tipped over.

 

and there being no further additions, corrections or deletions;

 

MOTION by Lacey, seconded by Mason to approve the July 9th, 2009 Attica Township Board minutes as corrected.  A vote was taken.  Ayes: All; Nays: None. MOTION CARRIED.

 

CORRESPONDENCE:   

 

1.         ISO Certification:  Supervisor Ochadleus informed the Board that the Township again has certification from ISO (Insurance Service Organization). This certification is valid for five years.

 

TREASURER’S REPORT:   Treasurer Mason gave the following Treasurer’s Report:  Beginning Balance of $354,766.52 receipts of $57,440.79; Interest of $69.55 Distributions of $42,176.09 for a New Balance of $370,100.77. Public Safety has $4,668.79; Fire Millage has $15,720.60 and there is $2,238.38 in the Lake George Road Special Assessment account.  There is a C.D. in the amount of $70,911.00.

 

MOTION by Lacey, seconded by Madeline to approve the Treasurer’s Report as presented. A vote as taken. Ayes: All; Nays: None. MOTION CARRIED.

 

POLICE REPORT:    Supervisor Ochadleus gave the following police report: 197 calls were received in the month of July, with 84 of them handled by the Township’s deputies.

 

OLD BUSINESS:  

 

1.         Dean Campbell Case:

 

            Attorney Gildner reported that Dean Campbell appeared in court without an attorney and asked for 2-3 weeks to clean up property and stated that he had ceased all business on the property. Attorney Gildner asked for an adjournment and Mr. Campbell is due back in court on August 24th, 2009. Mr. Campbell met with Supervisor Ochadleus and Zoning Administrator Fackler at the site and he agreed to come into the Township Hall and pay $200 per week towards his fine. Mr. Campbell came in the first week but did not come in the following two weeks. Mr. Campbell also was absent from a meeting scheduled with Zoning Administrator Fackler.

 

NEW BUSINESS:  

 

1.          Adopt clearzoning® Ordinance:

 

            AN ORDINACE to adopt a new Attica Township Zoning Ordinance; to repeal all prior ordinances in conflict therewith; and to provide penalties for violations thereof.

 

ATTICA TOWNSHIP HEREBY ORDAINS:

 

Section 1.     Adoption of New Attica Township Zoning Ordinance.

 

            The Township Board adopts, in its entirety, the ordinance as prepared by BIrchler Arroyo Associates, Inc. and recommended for approval by the Township Planning Commission following a public hearing.

 

Section 2.     Title.

 

            This ordinance shall be known as the Attica Township Zoning Ordinance.

 

Section 3.     Violations.

 

            Violations of the Attica Township Zoning Ordinance shall be punishable as specified in that ordinance.

 

Section 4.     Repeal of Prior Ordinances.

 

            All prior ordinances, or parts thereof, in conflict with the terms of the Attica Township Zoning Ordinance are repealed.

 

Section 5.     Effective Date.

 

            This ordinance shall become effective 7 days after publication in accordance with law.

 

MOTION At a regular meeting of the Board of Trustees for the Township of Attica held on the 13th day of August 2009, Herpolsheimer moved for adoption of the foregoing ordinance and Madeline supported the motion. A roll call vote was taken. Ochadleus: Aye; Mason: Aye; Madeline: Aye; Herpolsheimer: Aye and Lacey: Aye. Ayes: All. Nays: None. MOTION CARRIED.

 

COMMITTEE REPORTS

 

1.         FIRE: 

 

            a)         Chief Warford discussed the damage in the Township because of the storm on August 8th. The Fire Department was very busy because of the storm and helped two residents with collapsed basement walls. Supervisor Ochadleus commended the Fire Department on the excellent work they did after the storm.   

 

            b)         Chief Warford reported on the 911 Center millage that will be on the ballot in the November election.         

                         

2.         PARK:   Park Manager Madeline reported:          

 

            a)         There was so much water in the park after the storm that children were jumping off of the bridge and swimming.

 

            b)         The new mower deck has been put on the tractor.

 

3.         PLANNING COMMISSION: Planning Commission Secretary Bud Fackler reported:

 

            a)         The Planning Commission scheduled a public hearing for ordinances for wind turbines and emergency temporary dwelling units.

 

            b)         Planner Bessey recommended the wood burner ordinance be a separate ordinance, rather than a zoning ordinance.

 

            c)         Gravel mining operations have not been inspected in two years and there have been complaints about encroachment on property lines and non compliance with operating under guidelines.

           

4.         ATTORNEY REPORT:  Attorney Gildner had nothing further to report.

 

5.         AMBULANCE:   None.

 

6.         CEMETERY:   Resident Angie Burgess stated that she is very pleased with how well the cemetery is being taken care of.

 

7.         COMMISSIONER REPORT:    None.

 

8.         BOARD:  Trustee Madeline reported that he has been working with Janet O’Donnell on the Attica Historical Museum. Supervisor Ochadleus commended Ms. O’Donnell on the great job she has been doing setting up the museum.

 

10.       PUBLIC:   Pleasant Soul Café Owner Angie Burgess gave on overview of her efforts to restart the annual Attica Days celebration. Attica Days will be held September 12th at the park. There was lengthy discussion.    

                                                                                                                              REVIEWING AND PAYING BILLS:

 

The bills were reviewed by the Board in the amount of $90,060.50 and there being no questions:

 

MOTION by Lacey, seconded by Madeline to approve the bills as presented. A roll call vote taken. Herpolsheimer: Aye; Lacey; Aye; Madeline: Aye; Ochadleus: Aye and Mason: Aye. Ayes: All. Nays: None. MOTION CARRIED.

 

There being no further business before the Board, MOTION by Lacey seconded by Madeline to adjourn the meeting at 8:02 p.m. A vote was taken. Ayes: All. Nays: None. MOTION CARRIED.
