MINUTES OF THE ATTICA TOWNSHIP BOARD
Held on December 10th, 2009

At a meeting of the Attica Township Board held on December 10th, 2009, at the Attica Township Hall, 4350 Peppermill Road, Attica, Michigan. The meeting was called to order at 7 p.m. by Supervisor Ochadleus. PRESENT: Supervisor Al Ochadleus, Clerk Nancy Herpolsheimer, Trustee Richard Lacey and Trustee Phillip Madeline. ABSENT: Treasurer Pam Mason. ALSO PRESENT: The public per the Sign-In Sheet attached. Attorney Michael Gildner was not in attendance; he had informed Supervisor Ochadleus that he would be unable to attend the meeting.
The minutes of the November 12th, 2009 regular Board meeting were reviewed by the Board; and there being no additions, corrections or deletions;
MOTION by Lacey, seconded by Madeline to approve the November 12th, 2009 Attica Township Board minutes as presented. A vote was taken. Ayes: All; Nays: None. Absent: One (Mason). MOTION CARRIED.
CORRESPONDENCE: Supervisor Ochadleus reported that for the first time in over eleven years the November Construction Code Authority showed zero permits for Attica Township.
TREASURER’S REPORT: Supervisor gave the following Treasurer’s Report: Beginning Balance of $264,731.43 receipts of $55,205.31; Interest of $44.50; Distributions of $72,927.65 for a New Balance of $247,008.59. Public Safety has $13,284.17; Fire Millage has $832.20 and there is $1,066.45 in the Lake George Road Special Assessment account.
MOTION by Lacey, seconded by Madeline to approve the Treasurer’s Report as presented. A vote was taken. Ayes: All; Nays: None. Absent: One (Mason). MOTION CARRIED.
POLICE REPORT: Supervisor Ochadleus gave the following police report: 203 calls were received in the month of November, with 104 of them handled by the Township’s deputies.
OLD BUSINESS: None.
NEW BUSINESS:
1. Attica Little League:
President of the Attica Little League, Stewart Shaffer, and Secretary of the Attica Little League, Heidi VanKersen, gave an overview of the Attica Little League and agreed to stay in communication with Park Manager Phil Madeline.
2. MTA Conference:
There was discussion regarding the January 2010 MTA Conference and it was decided, because of the current economic conditions, that the Attica Township Board will not attend the January 2010 MTA Conference.
3. Board of Review Training:
The Board of Review Training for 2010 will be held February 3rd at the Edison Inn.
MOTION by Herpolsheimer, seconded by Madeline to authorize the Township Supervisor, the Township Assessor and the three members of the Attica Township Board of Review to attend the Board of Review Training on February 3rd, 2010 at the Thomas Edison Inn, at a cost of $85 each. A roll call vote was taken. Herpolsheimer: Aye; Madeline: Aye; Ochadleus: Aye, and Lacey: Aye. Ayes: All; Nays: None. Absent: One (Mason). MOTION CARRIED.
4. King, C.P.A. Contract for End of Year Services:
Discussion regarding RLK Accounting Group, L.L.C., providing year end tax services this year because of the switch to a new accounting system.
MOTION by Lacey, seconded by Herpolsheimer to authorize RLK Accounting Group, L.L.C. to provide the Township with the following services: 4th Quarter Form (941-Employee Quarterly Tax Return) and Annual Forms (165-Michigan Sales, Use and Withholding Report and W-2”s, W-3, 1099/s and 1096, which includes the reconciliation of the forms from the four quarters with the W-2’s and W-3). This contract is authorized for this year only. A roll call vote was taken. Herpolsheimer: Aye; Ochadleus: Aye; Madeline: Aye, and Lacey: Aye. Ayes: All; Nays: None. Absent: One (Mason). MOTION CARRIED.
5. Amend Ordinance:
MOTION by Madeline, seconded by Herpolsheimer to amend Articles 2, 3, 4 and 7 of the Attica Township Zoning Ordinance as recommended by the Planning Commission. A vote was taken. Ayes: All; Nays: None. Absent: One (Mason). MOTION CARRIED.
6. Budget Adjustment:
Clerk Herpolsheimer went over the following budget adjustment needed:
Transfer $6,000 from the General Fund to the Fire Department to cover expenses.
MOTION by Herpolsheimer, seconded by Lacey to transfer $6,000 from the General Fund to the Fire Department to cover expenses. A vote was taken. Ayes: All; Nays: None. Absent: One (Mason). MOTION CARRIED.
6. Projected Budgeting:
Supervisor Ochadleus discussed projected budgeting due to decreased revenue sharing and decreased tax income. There was lengthy discussion.
COMMITTEE REPORTS
1. FIRE: Fire Chief Warford presented proposed 2, 5 and 10 year plan for the purchase of new fire equipment.
2. PARK: Park Manager Madeline reported that the last port-a-john has been removed from the park and the park is now closed for the winter.
3. PLANNING COMMISSION: There was not a Planning Commission meeting in December.
4. ATTORNEY REPORT: None.
5. AMBULANCE: None.
6. CEMETERY: None
7. COMMISSIONER REPORT: Commissioner Jarvis reported:
a) H1N1 vaccine is now available to all residents in the county.
b) Project Homeless Connect will take place January 12th, 2010 from 10 a.m.-2 p.m. at the Center Building.
c) Mary Hawkins, of Lapeer County Promise is seeking donations for scholarships.
d) Discussed budget cuts for the County.
e) The County Commissioners took no position regarding ambulance service.
8. Board: Supervisor Ochadleus informed the board that the Lapeer County Road Commission delivered an unsolicited bid for brush mowing. It was decided that the Attica Township Board will not consider it.
PUBLIC: Resident Chuck Herpolsheimer stated his support for the Attica Township Fire Department
REVIEWING AND PAYING BILLS:
The bills were reviewed by the Board in the amount of $67,691.46 and there being no questions:
MOTION by Lacey, seconded by Madeline to approve the bills as presented. A roll call vote taken. Ochadleus: Aye; Madeline: Aye; Lacey: Aye and Herpolsheimer: Aye. Ayes: All. Nays: None. Absent: One (Mason). MOTION CARRIED.
There being no further business before the Board, MOTION by Lacey seconded by Madeline to adjourn the meeting at 8:30 p.m. A vote was taken. Ayes: All. Nays: None. MOTION CARRIED.
